These Terms of Service ("Terms") govern your use of the WebTingle website monitoring service ("Service") operated by Usługi Informatyczne Marcin Andrzejczak, located in Łódź, 94-244, Poland ("Company", "we", "us", or "our").

1. Acceptance of Terms

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

WebTingle is a website monitoring service that:

  • Monitors websites for changes and updates
  • Captures screenshots and content changes
  • Sends notifications when changes are detected
  • Provides a web application
  • Offers Standard and Premium subscription plans with different monitoring capabilities

3. User Accounts and Registration

3.1 Account Creation

  • You must provide accurate, complete information when creating an account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must be at least 18 years old to create an account
  • One person may not maintain multiple accounts

3.2 Account Security

  • You are responsible for all activities under your account
  • Notify us immediately of any unauthorized account access
  • We are not liable for losses due to unauthorized account use

4. Subscription Plans and Billing

4.1 Plan Types

  • Standard Plan: 3,000 monthly checks, 10-minute minimum interval, 3 months data retention
  • Premium Plan: 9,000 monthly checks, 1-minute minimum interval, 6 months data retention
  • Free Trial: 14-day trial period for Standard plan, no credit card required

4.2 Payment Terms

  • Subscriptions are billed monthly or annually in advance
  • Payments are processed securely through Stripe
  • All fees are non-refundable except as required by law
  • Price changes will be communicated 30 days in advance

4.3 Usage Limits

  • Monthly check limits reset on the billing cycle date
  • Exceeding plan limits may result in service suspension
  • No unused checks carry over to the next billing period

5. Acceptable Use Policy

5.1 Permitted Uses

  • Monitor websites you own or have permission to monitor
  • Track legitimate business or personal websites for changes
  • Use the service for lawful purposes only

5.2 Prohibited Activities

  • Monitor websites without proper authorization
  • Attempt to circumvent usage limits or restrictions
  • Use the service to facilitate illegal activities
  • Overload or attempt to disable our systems
  • Monitor websites containing illegal content
  • Violate any third-party website's terms of service through monitoring

5.3 Compliance

  • You must comply with all applicable laws and regulations
  • Respect robots.txt files and website monitoring policies
  • Do not monitor websites that explicitly prohibit automated access

6. Data and Privacy

6.1 Your Data

  • You retain ownership of your monitoring data and configurations
  • We collect and store screenshots and content changes as part of the service
  • Your data is processed according to our Privacy Policy

6.2 Data Retention

  • Active monitoring data is retained while your account is active
  • After account termination, data may be retained for up to 30 days
  • You can request data deletion at any time

7. Service Availability

7.1 Uptime Commitment

  • We aim for 99.9% service availability
  • Scheduled maintenance will be announced in advance
  • No service level agreements are guaranteed

7.2 Service Limitations

  • Monitoring frequency is subject to plan limits
  • Some websites may block or limit monitoring attempts
  • We cannot guarantee successful monitoring of all websites

8. Intellectual Property

8.1 Our Rights

  • WebTingle platform, software, and documentation are our property
  • Our trademarks and branding are protected
  • You may not copy, modify, or distribute our software

8.2 Your Rights

  • You retain rights to your original content and data
  • We do not claim ownership of websites you monitor
  • Screenshots and monitoring data are provided for your use

9. Disclaimers and Limitation of Liability

9.1 Service Disclaimer

  • The service is provided "as-is" without warranties
  • We do not guarantee monitoring accuracy or completeness
  • Website changes may not be detected due to technical limitations

9.2 Limitation of Liability

  • Our liability is limited to the amount paid for the service
  • We are not liable for indirect, consequential, or incidental damages
  • We are not responsible for missed website changes or monitoring failures

10. Termination

10.1 Termination by You

  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial periods

10.2 Termination by Us

  • We may suspend or terminate accounts for Terms violations
  • We may discontinue the service with 30 days notice
  • Upon termination, your right to use the service ends immediately

11. Modifications to Terms

  • We reserve the right to modify these Terms at any time
  • Material changes will be communicated via email or service notice
  • Continued use after changes constitutes acceptance

12. Governing Law and Disputes

12.1 Governing Law

These Terms are governed by the laws of Poland, without regard to conflict of law principles.

12.2 Dispute Resolution

  • Disputes will be resolved in Polish courts
  • You agree to attempt good faith resolution before litigation
  • Class action lawsuits are not permitted
